This End User License Agreement ("EULA") is a legal agreement between you and MINJI KANG (the "Developer," "we," or "us"), the developer of the KOLUP mobile application (the "Licensed Application"). You and the Developer acknowledge that this EULA is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions; in case of conflict, the Apple Media Services Terms and Conditions will apply.
By using the Licensed Application, you agree to this EULA. If you do not agree, please do not use the Licensed Application.
The Developer grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application and, if you sell your Apple device to a third party, you must remove the Licensed Application from the device before doing so. You may not copy (except as expressly permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).
The Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
KOLUP is a mobile application that recommends outfit images and color combinations based on a color you choose. Recommendations are for reference only and do not guarantee any specific outcome.
The Licensed Application does not require sign-up or password-based login. It uses Firebase Anonymous Authentication to generate an anonymous identifier and may store onboarding selections in the cloud with your consent. You can delete this data at any time from within the app's Settings. See our Privacy Policy for details.
The Licensed Application offers an auto-renewing subscription that unlocks premium features.

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Licensed Application is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. Outfit and color recommendations are for reference only, and the Developer is not liable for service interruptions caused by factors beyond reasonable control, including third-party APIs such as weather data providers.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.
You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit the Developer's liability beyond what is permitted by applicable law.
All content in the Licensed Application, including outfit imagery, color data, and UI, is owned by the Developer or its licensors. You may not use it beyond personal, non-commercial use.
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., your wireless data service agreement).
You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
We may update this EULA from time to time. Updates will be posted on this page and take effect on the stated effective date.
This EULA is governed by the laws of the Republic of Korea, without regard to its conflict of laws provisions, except to the extent such law is preempted by applicable mandatory consumer protection laws of your country of residence.
